These Terms of Use govern your use of our mobile application and services. By downloading, installing, or using the MamaSaysSo app, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our app.

1. Acceptance of Terms

By downloading, installing, or using the MamaSaysSo app, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our app.

2. Description of Service

MamaSaysSo is a mobile application that provides pregnancy and postpartum support for mothers. The app provides:

• Daily journaling with guided prompts for pregnancy and postpartum
• AI-powered assistant for personalized insights and support
• Milestone tracking for both pregnancy and baby development
• Photo albums to preserve precious memories
• Mood and feeling tracking
• Timeline carousel for viewing memories and milestones

3. Electronic Communications

Visiting mamasaysso.app, using the MamaSaysSo app or sending emails to RST Labs, LLC constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

4. User Accounts

To use certain features of the app, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Children Under Thirteen

RST Labs, LLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the MamaSaysSo app or website only with permission of a parent or guardian.

6. International Users

The Service is controlled, operated and administered by RST Labs, LLC from our offices within the USA. If you access the MamaSaysSo app or website from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Company Content accessed through mamasaysso.app or the app in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

7. Indemnification

You agree to indemnify, defend and hold harmless RST Labs, LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the site, app or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. RST Labs, LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with RST Labs, LLC in asserting any available defenses.

8. Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms of Use, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms of Use, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms of Use or any disputes arising as a result of these Terms of Use, whether directly or indirectly, including Tort claims that are a result of these Terms of Use. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms of Use.

9. User Content

You retain ownership of any content you create, record, or upload to the app, including journal entries, photos, milestone records, and personal data. By using our service, you grant us a limited license to:

• Store and process your content to provide the service
• Use your content for service improvement (anonymized and aggregated)
• Provide AI-powered insights based on your content
• Backup and restore your data across devices

10. Acceptable Use

You agree not to:

• Use the app for any illegal or unauthorized purpose
• Upload content that is harmful, offensive, or inappropriate
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the app
• Share false or misleading medical information
• Violate any applicable laws or regulations

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the app. We are committed to protecting your personal information and maintaining the confidentiality of your pregnancy and parenting journey.

12. Subscription and Payments

Some features of the app may require a subscription. Subscription terms and payment processing are handled through the App Store and are subject to their respective terms. All subscriptions are billed through your Apple ID account and will automatically renew unless cancelled at least 24 hours before the end of the current period.

13. Intellectual Property

The app, including its design, features, and content (excluding user-generated content), is owned by MamaSaysSo and RST Labs, LLC and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software.

14. Limitation of Liability

MamaSaysSo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. The app is provided for informational and organizational purposes only and should not be considered a substitute for professional medical advice.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the app or via email. Your continued use of the app after such modifications constitutes acceptance of the updated terms.

16. Termination/Access Restriction

RST Labs, LLC reserves the right, in its sole discretion, to terminate your access to the website and app and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the website and app are unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
